Warranty conditions

Lenco Zonwering B.V., located in Best, Bedrijfsweg 8, hereby guarantees to the clients and their legal successors:

a. For a period of two years from the solar shading system, which has been shown to be the result of insufficient quality according to the applicable NEN standards; for a period of five years, defects in the coating layer resulting from the fact that the tolerance standards, as set by the association of materials for windows and facade construction (VMRG), have been exceeded.

b. For a period of two years on electrical drives and control components supplied by Lenco Zonwering B.V.

c. The aforementioned warranty periods are calculated from the completion date indicated on the provided warranty certificate from Lenco Zonwering B.V. and/or the date of the sales invoice from Lenco Zonwering B.V.

d. The warranty exclusively covers the replacement or repair of what the client demonstrates to be defective in terms of quality requirements, however, with the understanding that these activities will be at the expense of Lenco Zonwering B.V. up to the amount of the net contract price of the component in question.

e. The quality requirements referred to in this provision are understood to be those requirements as they stood on the day the quotation was issued.

f. Any claim for compensation of direct or indirect business or consequential damage is excluded. The client is obliged to indemnify Lenco Zonwering B.V. for all costs,
damage and interest that the latter may incur as a result of claims from third parties for compensation of said damages.

g. Defects for which a claim is made under this warranty must be reported to Lenco Zonwering B.V. in writing without delay. Lenco Zonwering B.V. undertakes to remedy defects,
for which a warranty claim is justified, as soon as possible. The client will provide Lenco Zonwering B.V. with ample opportunity to do so without charging any costs and will also allow the use of hoists or lifting equipment, scaffolding, glass washing installations, existing energy sources and the like without charging costs.

h. If Lenco Zonwering B.V. replaces components to fulfill the warranty obligations, the replaced components become the property of Lenco Zonwering B.V.

i. Replacement or repair does not extend or renew the warranty period.

j. The following are not covered by the warranty:

− Minor imperfections in the finish that do not detract from the soundness
− Defects or damage resulting from normal wear and tear, inexpert or incorrect use, failure to comply with or incorrect compliance with operating or maintenance instructions, or otherwise attributable to an act or omission of the client or third parties.
− Defects resulting from overdue maintenance. Depending on the pollution on site, clean the profiles at least once a year, preferably also taking into account the climatic conditions as indicated in the overview below. From zone 2 and higher, it is recommended to clean the profiles at least twice a year. The aluminium may be cleaned with a neutral cleaning agent dissolved in (warm) water. Therefore, do not use soda or alkaline agents. Abrasives are strongly discouraged as they damage the surface of the coating layer. We also advise inspecting the coating for damage during cleaning work and repairing it if necessary.
− Damage resulting from changes in shape in building structures, from incorrectly executed construction work or from the use of unsound building materials.
− Damage as a result of force majeure, such as fire, storm (wind force of more than 17.2 m/s), flood, drifting snow, etc.
− Damage as a result of a temporary or permanent change in the environment, or contact with chemically aggressive substances.
− Damage resulting from work not carried out on the delivered goods by or on behalf of Lenco Zonwering B.V.
− Discoloration or loss of gloss that falls within the standards.
− The object must be accessible from ground level by means of ladders, in accordance with applicable VCA provisions. The costs of any building provisions to be made
and/or the use of auxiliary material are not covered by the warranty.

k. The warranty will lapse if the client carries out or has repairs carried out to the delivered goods without the written permission of Lenco Zonwering B.V.

l. The warranty statement does not apply if the client fails to fulfill any obligation under these or other agreements existing between the parties.

m. All disputes that may arise as a result of these warranty provisions or further agreements that are a consequence thereof will be settled by the judicial authority that is also competent with regard to the agreement for delivery and assembly.
