Warranty conditions

Lenco Zonwering B.V., having its registered office at Best, Bedrijfsweg 8, hereby warrants to the principals and its legal successors:

a. For a period of two years of the sun protection system, which has been shown to be the result of insufficient quality according to the usual NEN standards; for a period of five years defects in the coating layer resulting from the fact that the tolerance standards, as set by the association of materials window and facade industry (VMRG), have been exceeded.

b. For a period of two years on electric drives and control components supplied by Lenco Zonwering B.V.

c. The stated guarantee periods shall be counted from the delivery date indicated on the guarantee statement provided by Lenco Zonwering B.V. and/or the date of the Lenco Zonwering B.V. sales invoice.

d. The warranty includes only the replacement or repair of that which is shown by the client to be defective in the sense of quality requirements on the understanding, however, that
that these activities shall be for the account of Lenco Zonwering B.V. at most of the amount of the net contract price of the part concerned.

e. The quality requirements referred to in this provision shall mean those requirements as they stood on the day the quotation was issued.

f. Any claim for compensation for direct or indirect business or consequential damages is excluded. Client shall be obliged to indemnify Lenco Zonwering B.V. for all costs,
damages and interest, which may arise for the latter as a result of third party claims for compensation for said damages.

g. Defects for which this guarantee is invoked shall be reported to Lenco Zonwering B.V. in writing forthwith. Lenco Zonwering B.V. commits defects,
for which warranty claims are justifiably made, as soon as possible. Client shall give Lenco Zonwering B.V. ample opportunity to do so without calculation of any costs and shall furthermore allow the use of hoisting or lifting equipment, scaffolding, glass washing installations, available energy sources and the like also without calculation of costs.

h. If Lenco Zonwering B.V. replaces parts in fulfillment of the guarantee obligations, the replaced parts shall become the property of Lenco Zonwering B.V.

i. Replacement or repair will not extend or renew the warranty period.

j. Out of warranty:

– Minor imperfections in workmanship, which do not impair soundness
– Defects or damages resulting from normal wear and tear, injudicious or improper use, non-compliance or improper compliance with operating or maintenance instructions, or otherwise due to an act or omission of the client or third parties.
– Defects due to overdue maintenance. Depending on the contamination on site, clean the profiles at least once a year, preferably also taking into account the climatic conditions as indicated in the overview below. From zone 2 and above, it is recommended to clean the profiles at least twice a year. The aluminum may be cleaned with a neutral detergent dissolved in (warm) water. Therefore, do not use soda or alkaline agents. Abrasives are strongly discouraged as they damage the surface of the coating layer. We also recommend inspecting the coating for damage during cleaning and repairing it if necessary.
– Damages, which are the result of changes in form in building structures, of construction work not properly performed or the use of unsound building materials.
– Damages as a result of force majeure, e.g., fire, storm (wind force greater than 17.2 m/s), flood, drifting snow, etc.
– Damage resulting from a temporary or permanent change in the environment, or contact with chemically aggressive substances.
– Damage resulting from activities not performed by or on behalf of Lenco Zonwering B.V. on the delivered goods.
– Discoloration or gloss loss that are within the standards.
– The object must be accessible from ground level by means of ladders, correspondingly applicable as defined in the SCC provisions. The cost of any
structural features and/or the use of auxiliary equipment are not covered by the warranty.

k. The guarantee lapses if client carries out repairs to the delivered goods or has repairs carried out without written permission of Lenco Zonwering B.V..

l. The warranty statement shall not apply if the principal is in default of fulfilling any obligation under this or other agreements existing between parties.

m. All disputes that may arise as a result of these guarantee provisions or further agreements resulting from them, shall be settled by the same court that is competent in respect of the agreement for delivery and assembly.
